Terms and Conditions

Terms and Conditions

Last updated: 13 August 2026

1. About these terms

These Terms and Conditions govern your use of https://postoffice.iamblairgowrie.co.za and any donation made through the website.

The website supports the Pinegowrie Post Office Precinct Project, a community-led initiative associated with the Blairgowrie Community Association (“BCA”, “we”, “us” or “our”).

By using the website or submitting a donation, you agree to these terms.

2. Nature of the project

The project aims to support the clean-up, security, repair, restoration and ongoing care of the Pinegowrie Post Office precinct and surrounding shared public space.

Planned activities may include:

  • Removing accumulated waste and illegal dumping
  • Cleaning and maintaining the precinct
  • Improving fencing, access control and perimeter security
  • Repairing damaged infrastructure
  • Obtaining materials, equipment and professional services
  • Supporting related project administration and community communication

The sequence and scope of work may change according to available funding, permissions, site conditions, quotations, volunteer capacity and other practical considerations.

3. Donations are not product purchases

Payments made through this website are voluntary project donations.

A donation does not constitute the purchase of a product or service. No physical item will be supplied, and no delivery, fulfilment or conventional order-processing stage applies.

After payment is confirmed, the contribution will be recorded as a completed donation.

4. Use of donations

Donations will be used to support the Pinegowrie Post Office Precinct Project and reasonable costs directly associated with administering, communicating, securing or implementing the project.

The BCA will use reasonable judgement when allocating funds among project priorities. A donor cannot direct or control a particular purchase unless the BCA has expressly agreed to a restricted contribution in writing.

If a specific activity becomes impractical, unlawful, unnecessary or impossible, the BCA may redirect the relevant funds to another reasonable need within the same project or a closely related precinct-restoration purpose.

5. Fundraising targets

Any fundraising goal displayed on the website is an estimate or project objective and not a guarantee that:

  • The full amount will be raised
  • Every proposed activity will be completed
  • Work will begin or finish by a particular date
  • Final costs will match preliminary quotations
  • Municipal, property-owner or other approvals will be granted

Project plans may be adjusted as information, quotations and circumstances change.

6. Surplus funds

If donations exceed the cost of the initially planned work, the remaining funds may be retained for ongoing maintenance, security, repairs or other reasonable needs connected with the Pinegowrie Post Office precinct.

The BCA will not distribute surplus project funds among donors.

7. Payment processing

Online payments are processed through PayFast.

By making a payment, you may also be subject to PayFast’s terms, privacy policy and security procedures.

A donation is considered received only once the payment provider confirms successful payment. The BCA is not responsible for payment failures, banking delays, declined transactions or interruptions outside its reasonable control.

8. Donation acknowledgements

After successful payment, we may send you:

  • A payment or donation confirmation
  • A thank-you email
  • A donation reference
  • Information about the project
  • Updates where you have agreed to receive them

Automated correspondence is provided for recordkeeping and acknowledgement purposes and does not constitute a tax certificate.

9. Tax deductibility

Unless the BCA expressly confirms otherwise in writing, donations made through this website should not be assumed to qualify for a section 18A tax deduction.

A payment confirmation or thank-you email is not a section 18A receipt.

Donors should obtain independent tax advice where necessary.

10. Refunds and payment errors

Because funds may be committed to project expenses shortly after receipt, donations are generally non-refundable.

We will nevertheless consider a refund where:

  • The same donation was processed more than once
  • The amount was entered incorrectly
  • The payment was demonstrably unauthorised
  • A technical error caused an unintended transaction

A refund request should be submitted to [insert email address] as soon as possible and preferably within seven days of payment.

The request should include the donor’s name, donation reference, payment date, amount and reason for the request.

Approved refunds will normally be returned through the original payment method. Payment-provider charges already incurred may be deducted where legally permissible and not recoverable by the BCA.

Nothing in this clause limits rights that cannot lawfully be excluded.

11. Public recognition

The donation form may allow you to authorise the BCA to thank you publicly by name, including on Facebook or other community channels.

This is optional. We will not intentionally publish your name as a donor unless you have selected the applicable consent option.

Public recognition does not give a donor sponsorship rights, advertising rights, ownership rights or control over the project.

12. Donor responsibilities

You confirm that:

  • The information you provide is accurate
  • You are authorised to use the selected payment method
  • The donated funds come from a lawful source
  • You are at least 18 years old or acting with the permission of a parent or legal guardian
  • You will not use the website for fraud, abuse or unlawful activity

We may reject, reverse or report a transaction where fraud, misuse or unlawful conduct is reasonably suspected.

13. No ownership or decision-making rights

Making a donation does not:

  • Create ownership in the precinct or project assets
  • Create a partnership, agency or employment relationship
  • Grant voting rights or committee membership
  • Give the donor authority to direct volunteers or contractors
  • Guarantee naming, sponsorship or promotional rights
  • Guarantee a particular project outcome

14. Volunteers and third parties

The project may involve volunteers, contractors, suppliers, municipal representatives, property stakeholders and other community organisations.

References to or participation by third parties do not necessarily mean that they endorse every statement on the website or accept responsibility for the entire project.

15. Project information and updates

We aim to share project information honestly and keep material information reasonably current.

However, photographs, budgets, targets, timelines, quotations and descriptions may change. Website content should not be treated as a contractual guarantee or professional advice.

16. Website availability

We aim to keep the website available and secure, but we do not guarantee uninterrupted or error-free access.

The website may be suspended temporarily for maintenance, security work, service-provider interruptions or circumstances beyond our control.

17. Intellectual property

Unless otherwise stated, the website’s text, design, branding, graphics and original project materials belong to the BCA or are used with permission.

You may share public project pages for genuine community-awareness purposes. You may not reproduce, modify or commercially exploit website material in a misleading manner or imply BCA endorsement without permission.

18. Privacy

Personal information is handled according to our Privacy Policy and applicable South African law.

The Privacy Policy forms part of these Terms and Conditions.

19. Limitation of liability

To the extent permitted by law, the BCA, its committee members and project volunteers will not be liable for indirect, incidental or consequential loss arising from:

  • Use or inability to use the website
  • Payment-provider or banking-system failures
  • Reliance on preliminary project information
  • Delays or changes caused by permissions, suppliers, weather, safety concerns or third parties
  • Unauthorised access beyond reasonable safeguards

Nothing in these terms excludes liability that cannot legally be excluded or limits any non-waivable statutory right.

20. Indemnity

To the extent permitted by law, you agree not to hold the BCA or its volunteers responsible for claims arising from your unlawful use of the website, fraudulent payment activity or material breach of these terms.

21. Governing law

These terms are governed by the laws of the Republic of South Africa.

Any dispute will be subject to the jurisdiction of the appropriate South African courts, after the parties have first attempted in good faith to resolve it directly.

22. Changes to these terms

We may update these terms to reflect changes to the project, website, payment arrangements or applicable law.

The current version will be published on this website with its effective date. Terms applying at the time of a donation will govern that transaction.
